NYC Parking Requirements After City of Yes, Zone by Zone
Do new NYC buildings still need parking?
It depends on the transit zone. In the Inner Transit Zone, no parking is required for homes created after December 5, 2024. In the Outer Transit Zone, the requirement ranges from 100% of units in R1 and R2 down to 12% in R8 to R12, with zero for ADUs, senior housing and income-restricted units. Beyond the Greater Transit Zone, rates are higher, with waivers for small requirements and small lots (ZR 25-211, 25-222, 25-232). Check any address free on Zohgo.
City of Yes replaced most of the old residential parking rules with a three-zone system. The tables below are copied from the adopted Zoning Resolution.
The three zones
- Inner Transit Zone: within Appendix I of the Zoning Resolution: Brooklyn Community Districts 1 to 3, the part of CD 6 northeast of Hamilton Avenue, and CDs 7 and 8; Manhattan CDs 9, 10 and 11; Queens CDs 1 and 2 and parts of CDs 3 and 4; and Roosevelt Island (ZR 12-10).
- Outer Transit Zone: the rest of Appendix I, plus blocks wholly or partly within a quarter mile of select transit stations or half a mile of other stations (ZR 12-10).
- Beyond the Greater Transit Zone: everything outside the special parking areas and both transit zones (ZR 12-10).
- The Manhattan Core and the Long Island City area keep their own parking chapters (ZR 25-021).
- The exact boundaries are the "Transit Zones Parking Geographies" layer on DCP's ZoLa map; if the map and text conflict, the text controls (ZR 12-10).
Inner Transit Zone: no requirement
In R1 through R12 districts inside the Inner Transit Zone, no accessory off-street parking is required for dwelling units or rooming units created after December 5, 2024 (ZR 25-211). Spaces that older buildings were required to provide follow the rules in ZR 25-212.
Outer Transit Zone rates
Multiply the number of dwelling units by the percentage for your district. If the result is at or below the waiver number, no parking is required (ZR 25-222).

Worked examples
- R6, Outer Transit Zone, 40 market-rate units: 40 x 25% = 10 spaces. That is at or below the waiver of 15, so no parking is required (ZR 25-222).
- R6, beyond the Greater Transit Zone, 40 market-rate units: 40 x 50% = 20 spaces, above the waiver of 10, so 20 spaces are required (ZR 25-232).
- R4, Outer Transit Zone, a new two-family house: 2 x 35% = 0.7, below the waiver of 5, so none required (ZR 25-222).
Other parking rules that still apply
- No spaces are required where there is no way to arrange them with street access that meets ZR 25-63 (ZR 25-222, 25-232).
- Rules for commercial and community facility parking, curb cuts and parking location are separate sections of Article II, Chapter 5.
- Special purpose districts and certain community districts have their own modifications (ZR 25-241).
Parking FAQ
Does NYC still require parking for new apartments?
Not in the Inner Transit Zone, where no parking is required for homes created after December 5, 2024 (ZR 25-211). Elsewhere a percentage of units still applies, with waivers that remove the requirement for many smaller buildings (ZR 25-222, 25-232).
How do I know which transit zone my lot is in?
Use the 'Transit Zones Parking Geographies' layer on DCP's ZoLa map, which the Zoning Resolution names as the official boundary (ZR 12-10). If the map and the written description ever conflict, the text controls.
Do affordable units need parking?
Not in the Outer Transit Zone, where income-restricted units in qualifying affordable housing are at 0%. Beyond the Greater Transit Zone they are at 50%, 25% or 12% depending on the district (ZR 25-222, 25-232).
Can I remove parking from my existing building?
Spaces created under earlier rules generally have to stay unless current rules would not require them, subject to conditions in ZR 25-212 and 25-231. Check those sections for your case.
Do I need parking for an ADU?
No. ADUs are at 0% in every zone (ZR 25-211, 25-222, 25-232).
